Sammann Company, Inc. d/b/a Peepers by PeeperSpecs (collectively “Peepers,” “we,” “us,” or “our”) is committed to the protection of our customers’ and partners’ privacy and to keeping any personal information provided to us secure.
The purpose of our privacy policy (this “Privacy Policy”) is to inform you about the types of personal information we gather about you, how we may use that information, whether we disclose it to anyone, and the rights and choices you have regarding that information. The phrase “personal information” means any information from which you can be identified or are identifiable, either directly or indirectly, such as your name, address, telephone number, device and browsing information, etc.
By using our Website or using our Services, you agree with the terms of this Privacy Policy, which is part of Peepers’ Terms of Service. You consent to the collection, use, and disclosure of your information in accordance with this Privacy Policy. If you do not agree with our policies and practices, please discontinue use of our Services immediately. By accessing and continuing to use our Services, you agree to the collection and use of information in accordance with this Privacy Policy.

1. What This Privacy Policy Covers
This Privacy Policy applies to personal information collected through our “Services,” which include:
- Our website located at https://www.peepers.com (the “Website”)
- Email, telephone, text message, and other electronic messages between you and us
- Workshops, demonstrations, tradeshows, conferences, and other events
- Promotions, product reviews, surveys, sweepstakes/contest entries, and when you otherwise voluntarily provide us information
- The Perfect Pair Finder, which captures your frame preferences (frames you like, frame shape, color, and style choices), your reading strength, and, if you choose to receive your results by email, your email address and marketing preference
- Virtual Try-On (see Sections 10 and 18)
- Our chat, survey, and other assistant tools (see Section 17)
This Privacy Policy does not apply to personal information collected by parties other than Peepers, including any third party, through any website, application, or content (such as advertising) that may link to or be accessible from or on the Website.
2. Data Controller, Data Protection Officer, and Representative
Peepers is the Data Controller of the Personal Data (as defined by the UK and EU General Data Protection Regulation or its respective successor) you provide through the Services.
At this time, Peepers is not required to appoint a Data Protection Officer or a representative in the EU, and has elected not to do so. Peepers may be contacted in any manner set forth below in the “Contact Us” Section of this Privacy Policy.

Peepers collects the following categories of personal information, including in the preceding twelve months, when you provide it directly to us and when you use the Services. This information includes both personally identifiable information and information which does not directly identify you:

Sensitive Information
Peepers does not collect, use, process, sell, or share personal information which is classified as sensitive information, except that, if and to the extent a scan of your facial geometry generated by our Virtual Try-On is treated as sensitive or biometric information under applicable law, it is handled as described in Sections 10 and 18. We do not use such information to infer characteristics and do not retain it beyond the Virtual Try-On session as described below.
We may also collect non-personally identifiable, aggregated information
- We may collect aggregated information, such as Website usage data.
- This data is collected in the aggregate only but may include or be combined with other user information that users have voluntarily submitted.
- We maintain and use such data in a de-identified, aggregate form and do not attempt to re-identify this data.
When do we collect personal information?
- We collect this information when you take certain actions like interacting with our Services, submitting a form to contact us, and becoming one of our vendors or customers.
- We collect information automatically when you browse our Website.
- Peepers collects information when we interact with individuals such as customers and vendors at events, tradeshows, conferences, or through contests.
How long do we keep personal information?
- Peepers uses several criteria to determine how long we should keep categories of personal information.
- We keep data until you close or deactivate your account, until we no longer have a business purpose for the data, or until we no longer have an obligation to keep it.
- Please understand that residual copies of the personal information can be stored in locations or formats that make complete erasure extremely difficult.
- The best way to ensure you control your information is to give us only the personal information that you are completely comfortable sharing with us.

- Social Networks
- If you provide your social network account credentials to us or otherwise sign in to the Services through a third-party site or service, some content and/or information in those accounts may be transmitted into your account with us.
5. How We Use the Information We Collect
Peepers uses personal information for a variety of business purposes. When you share personal information with us, we may use it for several purposes. For example, we use the information we obtain about you to:

- Creating and managing your account or other user profiles.

- Providing you with the products, services, or information you request.

- Allowing you to try on our products in a virtual environment.

6. How We Disclose Information to Others
Selling and Sharing
- Peepers does not sell your personal information, nor have we done so in the last twelve months.
- We do share your information. By “share,” we mean making personal information (such as browsing information) available to another party for cross-context or interest-based advertising.
- We share information with analytics and advertising partners, such as Google, Meta, Microsoft, and TikTok. Those parties may combine your browsing information, including information from your use of our Website, to generate interest-based advertisements.
- You can opt out of this sharing at any time using the “Do Not Sell or Share My Personal Information” link on our Website, by using the methods in Section 8, or by enabling a recognized opt-out preference signal such as Global Privacy Control (see Section 9).
We disclose your information to parties we work with

Service Providers: These parties help us provide the Services or perform business functions on our behalf. They are required by contract or law to only use or disclose the information as necessary to perform the business function on our behalf or as otherwise required by law. They process your voluntarily-provided payment card information necessary to process your payment.
- Please see our payment providers’ terms of service and privacy policy for information on each processor’s use and storage of your Personal Data.
- Third-party data sharing disclosure: We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We may share your Personal Data, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages.
- Analytics Partners: These parties provide analytics on web traffic or usage of the Services. They include companies that track how users found or were referred to the Services and companies that track how users interact with the Services.
- Advertising Partners: These parties help us market our services and provide you with other offers that may be of interest to you. They include ad networks, affiliate and influencer networks, and marketing providers.
- Parties You Authorize, Access, or Authenticate: Third parties you access through the Services, social media services, and other users.

The following list reflects the third parties that receive personal information through our Services as of the “Last updated” date above, grouped by what they do for us. We review this list regularly and will update it as our vendors change. Each provider’s handling of personal information is governed by its own privacy policy.
- Store platform and checkout: Shopify (shopify.com/legal/privacy), including Shop Pay and Shopify’s fraud-prevention and audience services; payment processors including PayPal, Apple Pay, and Google Pay.
- Email and text messaging: Klaviyo (klaviyo.com/legal/privacy).
- Customer support and chat: Gorgias (gorgias.com/legal/privacy); Voiceflow for our survey and assistant tools (voiceflow.com/privacy).
- Reviews, surveys, and user-generated content: Okendo (okendo.io/legal-end-users/privacy); Fairing post-purchase surveys (fairing.co/privacy); Archive, for Instagram and TikTok content you tag us in (archive.com/legal/privacy).
- Virtual Try-On: Fittingbox (fittingbox.com data privacy terms). See Sections 10 and 18.
- Analytics and site measurement: Google Analytics (policies.google.com/privacy); Microsoft Clarity (microsoft.com/privacy); Elevar, which routes our analytics and advertising events (getelevar.com/privacy); Statlas (statlas.io/legal/privacy-policy); Supermetrics, for reporting.
- Advertising and affiliate partners: Google Ads, Meta (Facebook and Instagram), Microsoft Advertising, X (Twitter), TikTok, Snapchat, The Trade Desk, Dstillery, AppLovin, Spotify Advertising, Awin/ShareASale, impact.com, and ShopMy. These partners receive browsing information only when you have not opted out (see Section 9).
- Direct mail: PostPilot, which prints and mails postcards to customers who have purchased from us or asked to hear from us (postpilot.com/privacy-policy).
- Customer-data enrichment: OuterSignal, which may supplement our existing customer records with publicly available demographic and household attributes to help us understand and segment our customers (outersignal.com/legal). You may opt out of profiling and targeted advertising as described in Section 7.
- Store locator: Storemapper (storemapper.com/privacy), which runs the map and search on our store locator page. If you use the store locator’s location feature, your coordinates are sent to Storemapper to run the search, to Google Maps to draw the map, and are recorded in Storemapper’s usage analytics, provided by Keen (keen.io/privacy-policy). They are not linked to your customer record.
- Back-in-stock notifications: AMP (useamp.com/legal), which powers the “notify me when available” option on product pages and receives the email address or phone number you enter there.
- Location estimation: ipdata.co, which estimates your approximate location from your IP address so we can show region-appropriate content, pricing, and privacy choices (ipdata.co/privacy).
- Tax, shipping, and operations: Avalara (sales tax), our shipping carriers, and our order-management and accounting systems.
- Cookie consent management: Consentmo (consentmo.com privacy policy), which records the choices you make in our cookie banner and privacy-request forms.
We disclose information under other circumstances and to other parties
- When you consent. Out of respect for your privacy, Peepers will not disclose your personal information to others without your consent, except as specified in this Privacy Policy.
- To our affiliates and companies in the same group of companies as us. Our affiliates and subsidiaries (i.e., any organization or brand we own or control) or our ultimate holding company Sammann Company Inc., (i.e., any organization that owns or controls us) and any subsidiaries it owns. We may disclose the personal information that we collect to other Peepers companies, subsidiaries, and related affiliates. These companies may use your personal information in the same way as we can under this Privacy Policy.
- To the public. When you provide feedback or post user content on our Service. For example, if you post a product review on our Website or a comment on our social media sites, your personal information, such as your first name, last initial, state of residence, or your comments, may appear on our Website or social media pages.
- To purchasers and third parties in connection with a business transaction. Personal information may be disclosed to third parties in connection with a Peepers-related transaction, such as a merger, sale of Peepers assets or shares, reorganization, financing, change of control, or acquisition of all or a portion of our business by another company or third party, or in the event of a bankruptcy or related or similar proceedings.
- When law enforcement, regulators, and other parties request information for legal reasons. We may provide personal information without your consent to third parties as required by law or subpoena or if we reasonably believe that such action is necessary to: comply with the law and the reasonable requests of law enforcement; enforce our Terms of Service or protect the security or integrity of our Service; and/or exercise or protect the rights, property, or personal safety of Peepers, our visitors, or others.
7. Your Privacy Rights
Certain laws, including the California Privacy Rights Act, the Virginia Consumer Data Protection Act, the Colorado Privacy Act, and comparable laws in other states as they take effect, grant you rights to control your personal information. Consistent with these laws, Peepers gives you options to access, edit, or remove certain information, as well as choices about how we contact you. Although some of these rights apply generally, certain rights will only apply to limited individuals or circumstances.
- Right to Know and Access Information. Much of the information you are entitled to know or access is disclosed in this Privacy Policy. You have the right to know about our information practices and to access the categories of data we collect, with whom we share or sell that information, and, in some cases, what specific personal information we associate with you or your account.
- Right to Data Portability. If you request a copy of specific information we have about you then we will provide it in an easily accessible format.
- Right to Deletion or Erasure. You may request that we delete the personal information we have collected about you. Depending on the applicable law, in some cases we are required or permitted to retain that information, even if you validly requested we delete or erase it.
- Right to Correct Information. You may request we correct or rectify inaccurate information we associate with you or your account.

Right to Opt Out. You may limit certain ways we use your personal information (also called “opting out” or a “request to opt out”). You may opt out of:
- The sale of your personal information.
- The sharing of your personal information for targeted advertising purposes.
- Our use of your personal information for building a profile about you or making inferences about your characteristics, attributes, or behaviors in furtherance of decisions that produce legal or similarly significant effects.
- Right to Withdraw Consent. You may withdraw your consent to our data privacy practices.
- Right to Non-Discrimination. You have the right to not experience discrimination from us for exercising the rights listed in this section. What we mean by discrimination is denying you access to our Services or limiting the quality of our Services. However, limiting use of, or deleting, your personal information may restrict the purposes or uses that rely on that information. California residents
Our Privacy Notice for California Residents supplements this Privacy Policy with the category-level disclosures required by the CCPA/CPRA.
Canadian residents
If you are in Canada, our handling of your personal information is also governed by the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, provincial laws such as Quebec’s Law 25 and the British Columbia and Alberta Personal Information Protection Acts. You have the right to access and correct your personal information and to withdraw your consent, and, in Quebec, to data portability and to be informed about automated decision-making. You may also make a complaint to the Office of the Privacy Commissioner of Canada or, in Quebec, the Commission d’accès à l’information.
8. Exercising Your Rights
To exercise any of your privacy rights, either:

- Please include your email address, full name, and your specific information about your request(s) and, if applicable, specifically what information you do not want to receive.
- If you would like to update or correct your email address, street address, or other personal information with us, please include specific details about the information you wish to have updated or corrected.
- If you are appealing a decision please provide information about the denied request.
Peepers’ process to fulfill a privacy rights request:
First, we acknowledge your request
- Peepers will first send you a message acknowledging receipt of your request.
Next, we ensure that you are the person making the request
- In general, when you make a request Peepers will take steps to verify your identity.
- Verification steps may include asking you for personal information, such as your name, address, or other information we maintain about you or your child.
- If we are unable to verify your identity with the degree of certainty required, we will not be able to respond to the request. In that case, we will notify you to explain the basis of the denial.
Finally, we provide a response
- We will either honor your request or tell you why we denied it.
Your agent can submit requests for you
- You may also designate an authorized agent to submit requests on your behalf.
- If you do so, you will be required to verify your identity by providing us with certain personal information as described above.
- Additionally, we will also require written proof the agent has permission to act on your behalf.
- We will deny your request if the agent is unable to submit proof to us that you have authorized them to act on your behalf.
How long will it take?
- Peepers will either fulfill or reject your request as soon as we can, generally within 45 days from when we receive your request (or less, if required by law).
- But we may be allowed to take longer to process your request under certain circumstances.
- We will let you know if we expect your request will take us longer than normal to fulfill.
What if my request is denied?
- You may appeal your denial if you feel we have made a mistake.
- To submit an appeal please use the same method of contact listed above.
- If you are still not satisfied with our response then, under certain circumstances, you may contact your state privacy enforcement agency.
9. Your Privacy Choices
Messaging and newsletter communications
- You may control how you receive certain types of communications by unsubscribing within the body of the communication.
- Note that some messages are required, service-related messages like transaction confirmation messages, legal notices, or updates.
- If you no longer wish to use our Services or the website, or receive optional communications then you may submit requests to delete your account and your personal information to privacy@peepers.com.
We may send you direct marketing communications, product information and promotional offers:
- If you have consented to receiving such communications from us
- If we have an existing business relationship with you and can rely on your implied consent
- If you are from a country where the laws permit us to send you such communications based on our legitimate interests, if you have bought a product or service from us, and have not opted out of receiving communications from us (for example the EEA or UK)
- If you are from a country where the laws permit us to send you such communications
The marketing communications we send will be in relation to our own products or services. Your personal data will not be used for third-party direct marketing unless separate explicit consent has been collected for that or you are from a country where the laws permit such processing. You will always have full control of your marketing preferences. If you do not wish to continue receiving marketing information from us at any time:
- You can unsubscribe by using the unsubscribe directions or link included in marketing communication from us; or
- You may withdraw your consent by contacting us by e-mail at privacy@peepers.com.
Customers located in certain regions, such as the EEA and UK, also have the right to object to their personal data being processed for direct marketing purposes at any time. If you would like to object you can contact us by e-mail at privacy@peepers.com. We will process all requests as soon as possible, but please note that due to the nature of our IT systems and servers it may take a few days for any opt-out request to be implemented.
For recipients in Canada, our marketing emails and texts are sent in compliance with Canada’s Anti-Spam Legislation (CASL), with your consent and an unsubscribe option in every message.
Global Privacy Control (GPC) and other browser signals
We recognize the Global Privacy Control (GPC) signal. When you visit our Website with GPC enabled on your browser or device, we treat it as a valid request to opt out of the “sale” or “sharing” of personal information for that browser or device. Because other “Do Not Track” signals are not yet uniform, we may not respond to them, but you may exercise your choices as described in Sections 7 and 8.
Cookies and web tracking technologies
What we use on the Services.
- We use cookies and other embedded tracking technology like web beacons and pixels which automatically collect users’ browsing information when they use our Website.
- When you first visit our Website you will see a cookie banner. You can accept or decline non-essential cookies there, and you can change your choice at any time using the “Do Not Sell or Share My Personal Information” link in the footer of every page.
- SMS abandoned cart disclosure: The website uses cookies to help keep track of items you put into your shopping cart including when you have abandoned your cart and this information is used to determine when to send cart reminder messages via SMS.
Third-Party Cookies. You will find other parties’ trackers on our Website. Other parties like our analytics and advertising partners place code with cookies or web beacons embedded in them. Some third-party cookies are used to track a particular user’s activity across the Internet. When you decline non-essential cookies or opt out of sharing, we instruct these partners’ tags not to load.
Limiting Google’s Tracking and Data Collection Through Cookies. You may limit the automatic collection of information by Google, including the collection of personal information about your online activities over time and across third-party websites or online services, by opting out of such collection. Download the Google Analytics opt-out browser extension to opt out of the automatic collection of browsing and device data.
Opt out of cross-site and interest-based advertising
First, this is not a universal opt-out request you submit to us.
- Submitting a request to opt out of cross-site advertising using the methods below is not the same as opting out of the way we use your personal information.
- We do not receive your opt-out of cross-site advertising.
- For more details on limiting how we use your information, see Section 7 regarding Your Privacy Rights.
What happens when I opt out of cross-site advertising? When you opt out, your selection is stored on a cookie on your device. If you delete the cookie from that device or sign in from a different device, you will need to opt out again.
Does opting out of cross-site advertising stop all data collection? Because the data used for interest-based advertising is also used for other necessary purposes (including providing our Service, for authentication, and security purposes), opting out of interest-based advertising does not stop the data from being collected nor reduce the number of advertisements you will see. However, the data will not be used for interest-based advertising, which means the advertisements you do see may be less relevant to you.
Is my mobile device included when I opt out of cross-site advertising?
- When using a mobile application, you may receive interest-based in-application advertisements.
- Depending on your device, you may be able to reset your mobile device’s advertising identifier at any time by accessing the privacy settings on your device.
- In addition, each operating system (e.g., iOS for Apple devices, Android for Android devices and Windows for Microsoft devices) provides its own instructions on how to prevent the delivery of interest-based in-application advertisements.
- You may review the support materials and/or the privacy settings for the respective operating system in order to opt out of interest-based in-application advertisements.
- For any other devices and/or operating systems, please visit the privacy settings for the applicable device or contact (or review the applicable privacy web page of) the applicable platform operator.
Limit the automatic collection of information by any participating third-party advertisers. To submit your request to opt out of that automatic collection of browsing data, visit the Digital Advertising Alliance page or the Network Advertising Initiative page.
10. Virtual Try-On
Virtual Try-On (“VTO”) is a service that allows you to see how certain Peepers products will fit you from the comfort of your home or office.
Who operates VTO?
- VTO and its optional add-on are published by FITTINGBOX, our service provider for this feature.
- FITTINGBOX’s handling of data is governed by its own data privacy terms, which you are shown and asked to accept before the camera activates.
How does it work?
- When you use VTO, FITTINGBOX operates a scan or a reconstruction of the appearance of your face so that a pair of glasses can be positioned on your image.
- Your image is processed live, in your own web browser, only for the duration of the virtual try-on experience. Neither Peepers nor FITTINGBOX stores your camera image.
- If you choose photo mode, the photo you upload is used for the try-on session only and is kept in your browser’s local storage, not on our servers.
What permissions and data are needed?
- VTO will need access to your webcam (or a photo you choose) to provide the service.
- Small amounts of data may be stored locally in your browser when you use VTO, including a session identifier and a record that you accepted the notice, which expire after about 30 minutes.
Notice and consent

We and FITTINGBOX do not sell your image or facial-geometry data, do not use it to identify you, and do not use it to train artificial-intelligence models. Any such data is processed live and is permanently destroyed when the purpose for collecting it has been satisfied or within 30 days of your last interaction with the service, whichever occurs first, consistent with our written retention and destruction policy described in Section 18. We keep a record that you were shown this notice and of the choice you made (the date and time, the version of the notice, and the product you were viewing), but not any image or facial-geometry data. If you do not consent, do not use VTO; you can still shop without it.

When we collect information, it is stored in an area to which the general public does not have access. In the event that any use of the Website involves log-in credentials, please bear in mind that anyone you provide with your log-in information will also have access to your account and personal information. You must be the age of majority to use our Services. Peepers takes children’s privacy seriously. Peepers does not have actual knowledge of any personal information about individuals under the age of 16 whose information has been collected through our Services. If we become aware that a person submitting information to us through any part of our Services is a minor, we delete the information as soon as we discover it and do not use it for any purpose nor disclose it to third parties. We do not knowingly sell or share the personal information of consumers under 16, and we do not offer Virtual Try-On or other biometric features to individuals we know to be under 16.

17. Artificial Intelligence
We use certain artificial-intelligence and automated tools to help you shop and to support customer service, such as our Virtual Try-On, Perfect Pair Finder, strength and fit guides, product recommendations, and our chat and survey assistants (provided through Voiceflow and its model providers). These tools help visualize products, suggest options, and answer questions. They are provided for convenience and are not a substitute for professional eye-care or medical advice.
We do not use these tools to make decisions that produce legal or similarly significant effects about you without human involvement. We do not sell the personal information you provide to these tools, and we do not use your facial-geometry data or images to train artificial-intelligence models. Where an AI feature is operated by a third-party provider, that provider’s handling of data is governed by its own terms and privacy policy, and we share only the information needed to provide the feature. 18. Biometric Data
This Section is our biometric privacy notice and policy. When you choose to use Virtual Try-On or a similar feature, we and our service provider (FITTINGBOX) may capture a temporary scan of your facial geometry, which may be considered “biometric information” or a “biometric identifier” under laws such as the Illinois Biometric Information Privacy Act (BIPA) and comparable Texas and Washington laws.
Purpose and consent: We collect and use this data only to provide the Virtual Try-On experience you request, and only after providing this notice and obtaining your consent. We do not use it to identify you, and we do not disclose or sell it.
Retention and destruction: Facial-geometry data is processed live for the duration of your session and is permanently destroyed when the initial purpose for collecting it has been satisfied or within 30 days of your last interaction with the service, whichever occurs first. We do not create a permanent biometric template. This is our written retention schedule and destruction guideline for such data.
Your choices: Use of Virtual Try-On is entirely optional. If you do not consent to the temporary processing of your facial geometry, do not use the feature; you can still browse and purchase without it. Questions may be directed to privacy@peepers.com.
Quebec and Canadian residents: We obtain your express consent before any capture of biometric characteristics. Because facial-geometry data is processed live and is not stored as a permanent template, we do not create a biometric database. If our practices ever change so that a biometric database is created, we will make any disclosures required by applicable law, including, in Quebec, to the Commission d’accès à l’information.
